Terms Of Service For Web Wave Designs

The customer must agree to these terms and conditions.

30% Deposit (Non-Refundable) Paid in advance:
There will be a 30% deposit paid in advance for any work done by Web Wave, LLC if the amount is over $1000. An invoice will be mailed to the client and payment will be made by check.

After having a consultation with the client, either verbal or written, Web Wave, LLC will produce a quote detailing the work to be carried out. The client must provide written confirmation that the quote is acceptable by signing and returning a copy of the quote. This will effectively form the basis of a legal binding contract. Once Web Wave, LLC has received the signed contract and deposit, we will then begin to create your web site. There will be a cancellation fee of up to 75% of the contract if terminated through no fault of ours.

Once the web site is created and online, the remained of the work will be billed for. We guarantee that your web site will not take longer two weeks to be online, given you have provided us all of the information to complete your site, or we will cut the contract price in half. If after two weeks of a signed contract we have not received all information from you for your web site, billing for the remainder of your web site and hosting charges will begin. There will also be a 1.5% late fee added to your account if your balance if not paid within 30 days of receiving your invoice.

The customer represents to Web Wave, LLC an unconditional guarantee that all elements of text, graphics, photos, designs, trademarks, or other art work furnished to Web Wave, LLC for inclusion in web pages are owned by the customer, and will not hold Web Wave, LLC responsible for any lawsuit or other action from arising from the use of such elements furnished by the customer. Web Wave, LLC does not warrant that the functions contained in these web pages site will meet the customer's requirements or that the operation of the web pages will be uninterrupted or error free. The entire risk as to the quality and performance of the web pages and web site is with the customer. In no event will Web Wave Designs be liable to the customer or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate the website, even if Web Wave, LLC has been advised of the possibility of such damages. Despite the best efforts of Web Wave, LLC errors in web page information will occur. At no time will Web Wave, LLC be responsible for accidentally including erroneous information extend beyond correcting the error.

Web Wave, LLC cannot be held liable for any information contained within the client's web site or printed literature. The content of such remains the copyright and intellectual property of the client.

Search Engine entry and ranking can in no way be guaranteed as this remains the sole discretion of a third party search engine provider; Google, Yahoo, MSN, etc.

Web Wave, LLC Copyright

Web Wave, LLC owns copyright to the finished web design site produced. The client will own the rights to the web design project as a web site, once site is uploaded/sent. Rights to photos, graphics, source code, work-up files and computer programs are specifically not transferred to the client, and remain the property of their respective owners. Web Wave, LLC retain the right to display graphics and other web design elements as examples of their work in their respective portfolios. All web design projects will contain a copyright/legal page with a link to Web Wave, LLC site.
